Rules and Regulations for Name Our Switzerland Tour Contest (the “Contest”)
1. NO PURCHASE NECESSARY. This contest is open to all legal residents of the United States, United Kingdom, Australia, New Zealand, or Canada (excluding Quebec) ages 18 and over.
Tauck employees, and immediate family members, are not eligible to enter or win. Excluded individuals also include shareholders, board members, consultants, independent contractors and interns.
Tauck reserves the right to verify the age of contest participants (“Contestant”) and compliance with other eligibility requirements.
2. DESCRIPTION. The Contest requires participants, 18 years and older to submit, online at Tauck’s Facebook page (www.facebook.com/taucktravel) or (the “website”). The entry period will begin on March 27, 2013, at 5:00 pm ET and end on May 8, 2013 at 11:59 pm ET (the “Entry Period”). Entrants of the Name Our Switzerland Tour may only submit one entry. Additional entries will be deemed null and void, and will be removed.
3. HOW TO ENTER/ASSIGNMENT OF RIGHTS. In order to enter, the following steps must be taken: (a) visit and register at www.facebook.com/taucktravel; (b) Submit the entry via the designated online form (c) agree to the Rules and Regulations at www.facebook.com/taucktravel and the Official Rules for the Contest; (d) agree that all information on the registration page becomes the property of Tauck. The entry must: 1) be complete to be eligible; 2) A tour name that must not exceed 35 characters in length. Entrants may not copy the entry from any source. Sponsor has the sole discretion to determine whether a tour name qualifies as an entry. All submissions will first be reviewed for compliance to the contest terms and conditions. Upon approval the entry will then be uploaded to the site on the ‘View Entry” page within 36 hours of submission. A confirmation email will be sent to the submitter on the provided e-mail address, to that effect. (e) Duplicate entries are not eligible, each entry is time stamped, Contest Administrator will notify the entrant if the tour name “Entry” is not eligible. (f) Any entry not in compliance with the above and which does not meet the requirements of these Official Rules will be disqualified. If the entry is rejected, the entrant /submitter can continue uploading an entry until they have an approved submission featured on the contest website. Tour name must be in keeping with Sponsor's family image requirements, and may not be offensive, as determined by Sponsor in its sole discretion. Any entry or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entry must be the sole, original work of the entrants. Modifying, enhancing or altering a third party's pre-existing work does not qualify as an original work. In such an event, the entries will be disqualified. All entries become the property of the Sponsor. Entrants and winner acknowledge and agree that their entries become the property of the Sponsor, which thereby has the right to edit, adapt, modify, reproduce, promote and otherwise use entries in any way they see fit. Automated, script, macro or robotic entries submitted by individuals will be disqualified. Entries cannot defame or invade publicity rights or privacy rights of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights. Any entry not in compliance with the above and which does not meet the requirements of these Official Rules will be disqualified. By entering, you agree to waive any rights you may have to the entry submitted. In addition to the above, each Entrant submitting an entry to the Contest agrees to the following intellectual property permissions:

4. QUALIFIED ENTRIES. To be qualified for the Contest, Contestant must submit a name for Tauck’s Switzerland tour that cannot exceed 35 characters. These qualifying trips may include products marketed under Tauck World Discovery™, Tauck River Cruising, Tauck Small Ship Cruising, Tauck Bridges or Tauck Culturious.
Each Entry must conform to the following:
a. Not have been previously published or otherwise distributed or disseminated in any media or format;
b. Not be in violation of or conflict with the trademark, copyright, rights of privacy, rights of publicity or any other rights, of any kind or nature, of any other person or entity, and;
c. Not include any language or other content that is indecent, inappropriate, morally objectionable or otherwise unfit for dissemination, and;
Entries that do not satisfy the above criteria may be disqualified. If Tauck, in its sole discretion, has reason to believe that any entry contains any material that may infringe or violate any law or any rights of a third party, or that the use of such an entry in the manner described herein may infringe or violate any law or any rights of a third party, Tauck may disqualify such entry.
Each entry is time stamped. If there are duplicate entries with the same name (ENTRY) submitted, the entry with the earliest time-stamp will be accepted and only the Entry received will be considered.
5. GRAND PRIZE WINNER. Will be selected by Tauck will be awarded a trip for two to Switzerland in 2014. The departure dates will be mutually determined between Tauck and the winner based on available cruise dates and the winner’s preference. The Grand Prize will include the following:
a. This is a Eleven (11)- Day, 10 night escorted tour to Switzerland Tour includes on tour transfers to and from airports furnished by Tauck.
b. Two (2) round trip airfare from the closest gateway for Swiss International Air Lines furnished by Switzerland Tourism (myswitzerland.com)
The approximate retail value (ARV) of the Grand Prize is $15,000.
The Grand Prize is subject to availability at time of booking and all travel must be completed by October 31, 2014. Certain restrictions apply. Winner must specify date of travel at time of booking and blackout periods will apply. The Prize winner and his/her traveling companion will be responsible for all expenses not specifically stated as part of the Prize, including but not limited to, airfare, any applicable taxes, fees, airport charges and carrier surcharge, nor does it include the local transportation including air or ground transportation from the winner’s home to the closest Swiss Airlines gateway airport, overnight accommodation prior to or following the travel dates in order to accommodate flight connections, income taxes, federal taxes, local taxes, insurance, passport and visa costs, gratuities, all meals, beverages, incidentals and any items of a personal nature. Cancellation insurance is not part of the Prize, but is recommended (must be arranged privately by winner). In the event of denied boarding, no compensation will be due by Tauck for costs directly or indirectly incurred. No mileage credit applicable. Winner is responsible for procuring adequate documentation for travel. Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part, for any destination.
Incomplete or inaccurate registration forms are void. Limit one (1) registration, per individual. A registration is defined as one (1) valid registration, linked to a valid e-mail address. No other form of entry/voting will be accepted. Any person who attempts to participate with multiple e-mail addresses, under multiple identities, or uses any device or artifice to enter multiple times in violation of the preceding entry limitation will be disqualified. Any use of robotic, automatic, macro, programmed, or like (online) entry or voting methods will void all such entries by such methods and result in disqualification of any entrant using such methods. ALL ENTRIES WILL BE THOROUGHLY REVIEWED and are subject to disqualification if any fraud is detected. Any fraudulent entries will be deemed void, and will result in immediate disqualification. All registration information obtained through either the Tauck contest portal, for the purpose of this Contest, becomes the legal property of Tauck.
8. PRIZE DETERMINATIONS/RESTRICTIONS. The Grand Prize will be awarded to the entrant whose entry receives the highest judges score, subject to verification.
In the event of a tie for any prize, Sponsor will make the final determination of the winner (in their sole discretion) from all tied entries.
9. GENERAL. Tauck is not responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, undelivered, inaccurate or not received by Tauck for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries; (iii) destruction of or unauthorized access to, or alteration of, entries; or (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to entrant’s or any person’s computer and/or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest. All incomplete or otherwise nonconforming entries will be disqualified. Tauck is further not responsible for: (i) incorrect or inaccurate entry or prize claim information whether caused by entrant or by any of the equipment or programming associated with or utilized in the Contest, or for any other errors of any kind, whether technical, network, printing, typographical, human or otherwise, in any Contest-related materials or in the announcement of prizes/prizewinners; or (ii) misrepresentation, cheating or fraud by any entrant. If any of the foregoing malfunctions, errors, defects or acts render the Contest incapable of operating as planned, Tauck, at its sole discretion, may suspend or cancel this Contest immediately and determine the winners as described above based on each type of prize from among all eligible entries received prior to and/or after (as appropriate) the action taken by Tauck, or in any other manner deemed fair and equitable by Tauck. All entries become the exclusive property of the Tauck and will not be returned or acknowledged except as provided herein. Any attempts by an individual to access the site via a bot, script or other brute-force attack will result in that individual’s e-mail address becoming ineligible, and the entry/entries submitted by that e-mail address becoming void. If Tauck, in its sole discretion, determines that an individual is tampering or attempting to tamper with the Contest or Web site, such individual will be disqualified. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WWW.TAUCK.COM/CONTEST RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. By entering this Contest, entrants agree to be bound by these Official Rules and the decisions of the Tauck, which shall be final, binding and conclusive on all matters relating to this Contest. Any information collected by registering to enter the Contest shall be used only in a manner consistent with these Official Rules and Tauck’s privacy policy.
Tauck is not responsible for any injury or damage to entrant’s or any other person’s computer system, property or anything stored on or related thereto as a result of participation in, or connection with, this drawing. Entrants release Tauck from all liability in connection with the drawing and any Prize won.
10. WINNER NOTIFICATION. The Grand Prize winner will be notified within two weeks after the end of the Contest. The selected entrants will be contacted by e-mail/mail. If the selected winner does not comply with the Contest Rules and Regulations and Tauck’s Terms and Conditions, that entrant forfeits any right to the Prize and an alternate winner will be determined. The Prizes are not transferable or convertible to cash and must be accepted as awarded. In a dispute, the authorized account holder of email address will be declared the winner of the Contest.
Tauck is not responsible for failure for any reason whatsoever of selected entrant to receive notification. Tauck will handle arrangements for the fulfillment of the Prizes.
In order to be eligible to win any of the above referenced prizes, the selected Entrants (and his/her traveling companion in the case of the Grand Prize) will be required to sign an affidavit/declaration of compliance with the Contest Rules and Regulations, an assignment of rights to entry and one or more releases waiving Tauck’s liability with respect to injuries, accidents, loss, or misfortune relating to the drawing and/or the awarding of the specific prize within the time specified. In addition, the selected entrant (and the traveling companion of the Entrant selected for the Grand Prize) must authorize Tauck to announce and publish their names, addresses, entries in any publicity. The affidavit/declaration and release must be returned by the dates indicated or prize will be forfeited an alternate may be determined/selected.
Failure to comply with all the drawing rules or to sign and return any of the release forms will result in disqualification and another entrant will be determined/selected (as applicable). A selected entrant will be declared a winner only after meeting all of the above terms and conditions.
The decisions of Tauck for the Contest, judging, voting and drawings will be final and binding on all Entrants. By entering, entrants agree that they have read, understood and agree to these Contest rules and regulations and release Tauck from all liability in connection with the drawings, judging, voting and/or any Prize. Prizes are subject to all applicable Federal, State and Local taxes, which are the responsibility of each winner.
By entering, all entrants agree to release and hold harmless Tauck, and each of Tauck, affiliates, subsidiaries, and the officers, directors, agents and employees of each of the foregoing, and all others associated with the development and execution of this Contest (collectively, the “Released Parties”), from and against any and all liability with respect to, or in any way arising from or in connection with, participation in this Contest and/or the acceptance, possession or use of any prizes that may be awarded to them, including, but not limited, to liability for personal injury, bodily injury, death, damages or loss of any kind. By accepting any of the prizes offered, the winners acknowledge and agree that Tauck, and each of Tauck, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including without limitation, its quality, mechanical condition or fitness for a particular purpose.
Tauck reserves the right to substitute a prize of equal or greater value in the event of non-availability of the prize for any reason. Void where prohibited.
11. GOVERNING LAW AND VENUE. The Contest is governed by the laws of the State of Connecticut. All cases and claims pertaining to The Contest must be brought in a court of competent jurisdiction in the State of Connecticut. . All federal, state and local laws apply.
12. WINNERS LIST. A complete winners list will be posted on the promotion site by May 23th, 2013

Failure to comply with all the drawing rules or to sign and return any of the release forms will result in disqualification and another entrant will be determined/selected (as applicable). A selected entrant will be declared a winner only after meeting all of the above terms and conditions.
The decisions of Tauck for the Contest, judging, voting and drawings will be final and binding on all Entrants. By entering, entrants agree that they have read, understood and agree to these Contest rules and regulations and release Tauck from all liability in connection with the drawings, judging, voting and/or any Prize. Prizes are subject to all applicable Federal, State and Local taxes, which are the responsibility of each winner.
By entering, all entrants agree to release and hold harmless Tauck, and each of Tauck, affiliates, subsidiaries, and the officers, directors, agents and employees of each of the foregoing, and all others associated with the development and execution of this Contest (collectively, the “Released Parties”), from and against any and all liability with respect to, or in any way arising from or in connection with, participation in this Contest and/or the acceptance, possession or use of any prizes that may be awarded to them, including, but not limited, to liability for personal injury, bodily injury, death, damages or loss of any kind. By accepting any of the prizes offered, the winners acknowledge and agree that Tauck, and each of Tauck, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including without limitation, its quality, mechanical condition or fitness for a particular purpose.
Tauck reserves the right to substitute a prize of equal or greater value in the event of non-availability of the prize for any reason. Void where prohibited.
11. GOVERNING LAW AND VENUE. The Contest is governed by the laws of the State of Connecticut. All cases and claims pertaining to The Contest must be brought in a court of competent jurisdiction in the State of Connecticut. . All federal, state and local laws apply.
